Threats with a gun lead to Aggravated Assault arrest; Daily incident report

   Arrested: William J. Mueller, 45, Boise

   Charges: Aggravated Assault (F)

    Boise Police responded to a report of a disturbance at a residence on the 9500 block of West Cory Lane yesterday, July 23rd, at approximately 5:30 p.m. The victim, an adult male, tells police the suspect pointed a rifle at him during an argument in the front yard of the home. The victim and the suspect are known to each other. Officers have evidence that indicates alcohol was a factor in this incident. After a detailed investigation, the suspect was transported to the Ada County Jail and booked on the above listed charges.

TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 9 ASSAULT AND BATTERY  18-905.  Aggravated assault defined.  An aggravated assault is an assault:  (a)   With a deadly weapon or instrument without intent to kill; or (b)   By any means or force likely to produce great bodily harm.  "Deadly weapon or instrument" as used in this chapter is defined to include any firearm, though unloaded or so defective that it can not be fired.
