10-14-11 Attempt to sell marijuana lands suspect in jail on 3 felony counts; Daily incident report

   Arrested: Steven J. Bankhead, 33, Transient

   Charges: 3 counts of Aggravated Assault (F), Possession of a Controlled Substance (marijuana)

    Boise Police responded to a report of a fight with a knife in Rhodes Park located on the 1500 block of W. Front Street yesterday, October 13th, at approximately 4:00 p.m. The victims in this case, three adult males, tell police they were skating in Rhodes Park when they were approached by the suspect who asked if they wanted to purchase marijuana. The victims tell police they refused the offer and at one point the suspect became angry, produced a knife and demanded money. All three victims tell police they feared for their lives and fled the immediate area before calling 911. Officers located the suspect in the park and a search of his person revealed a knife and a baggie containing approximately 10 grams total package weight of marijuana. After a detailed investigation the suspect was transported to the Ada County Jail and booked on the above listed charges.

TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 9 ASSAULT AND BATTERY18-905. Aggravated assault defined. An aggravated assault is an assault: (a)  With a deadly weapon or instrument without intent to kill; or (b)  By any means or force likely to produce great bodily harm.


    Arrested: Jamie L. Showalter, 33, Boise

    Charges:Driving Under the Influence (DUI)(F)

  Boise Police observed a vehicle stopped at a green light with no headlights in the intersection of W. Overland Rd. and S. Owyhee St. last night, October 13th, at approximately 10:30 p.m. The suspect, who appeared to be very intoxicated at the time, had slurred speech, bloodshot eyes and the odor of an alcoholic beverage on his person. The suspect refused to submit to field sobriety tests and a blood draw was performed for later evidentiary testing. A check through Ada County records indicated the suspect had prior convictions for DUI making this charge a felony. The suspect was booked at the Ada County Jail on the above listed charges.


  Warrant Arrested: Clayton J. Miller, 21, Boise

  Warrant Charges: Possession of a Controlled Substance with Intent to Deliver (F)

    The suspect was taken into custody on an outstanding felony warrant for possession of a controlled substance with intent to deliver yesterday.

   The arrest warrant stems from an ongoing investigation into the  discovery of a small amount of marijuana during a traffic stop in May of this year. Evidence indicates obtained during the course of the investigation indicates the suspect intended to sell the controlled substance. That investigative information was forwarded to the Ada County Prosecuting Attorney's Office and resulted in the felony warrant.
