12-14-10 DUI driver nearly hits Officers car; Teen arrested after driving through & damaging park; daily incident report

Arrested: Sheridan R. Swenson, 28, Nampa
Charges: DUI (F), Driving without privileges (m), Carrying a concealed weapon while under the influence of alcohol (m)

A Boise Police officer on patrol this morning at 3:07 a.m. traveling northbound on S. Orchard St near W. Targee saw a tan Dodge pick up traveling south. Suddenly the pick up swerved across the southbound lanes and into oncoming traffic directly into the path of the northbound patrol car, forcing the officer to swerve off the roadway to avoid being hit head on.

The officer turned around and stopped the pick up, which was still traveling south in the northbound lanes. The officer immediately smelled a strong odor of an alcoholic beverage coming from the driver, who also slurred his words and had red, glassy eyes. When the driver was asked to get out of his vehicle, the officer noticed he could barely stand. The driver gave the officer permission to enter the cab of the pick up to look for identification. In the center console, the officer found a loaded handgun and additional ammunition. The officer also found an Idaho ID card that identified the driver as Swenson. Officers found Swenson's driver's license was suspended from a previous DUI arrest. Swenson failed field sobriety tests and was placed under arrest on the above charges.  At the jail, a blood draw was taken for evidence. Officers found Swenson has two past DUI convictions on 6/1/06 and 3/23/09 making this a Felony DUI.

Arrested: James K. Spinks, Jr., 27, Boise
Charges: Battery on a Law enforcement Officer (F), resisting & Obstructing Officers (m)

Boise Police were called just before 1:00 a.m. this morning to a bar on the 1200 blk of Oakland Ave by employees who reported a man was drunk, unruly and refusing to leave the bar. When the first officer arrived at the bar, he could see two to three people attempting to push a man out the front door. The officer ordered the man, later identified as the suspect Spinks, to step back. The suspect was holding one of the witnesses by the arm and did not comply with the officers orders. The suspect was ordered again to let go and step back which he failed to do. The suspect then reached out and grabbed the officer by the elbow and attempted to draw the officer into the struggle. The officer deployed his Taser, which caused the suspect to let go of the officer and fall to the ground. The suspect continued to struggle as officers tried to take him into custody and eventually had to be restrained with hobbles for officer safety. Spinks was arrested on the above charges and booked into the Ada County Jail.

Boise Police were called late Sunday night, Dec. 12th, by a citizen reporting a possible fight occurring in a nearby apartment in a complex near S. Walnut St and E. Warm Springs Ave. When officers arrived at the apartment where the fight had reportedly occurred, several people inside told officers they had just been robbed, that the suspects had entered their apartment, a verbal confrontation turned physical, and the suspects had taken cash, more than $1,000 from a bedroom. The suspects were acquaintances of the victims. After investigating, officers found the suspects at a residence near W. Victory Rd and S. Maple Grove Rd. After further investigation, the suspects were arrested on the above charge. Officers believe drug sales are connected to the incident.

Arrested: Marcus A. Dunn, 18, Boise
Charge: Malicious Injury to Property (F)

Boise Police were called by a citizen Monday evening, Dec. 13th at approx 6:00 p.m. reporting a car driving recklessly and "spinning cookies" in the grass at Camel's Back Park. When officers arrived, they found a silver Saturn in the parking lot with mud and fresh grass in the wheel well and fenders. Several teenagers were standing next to the Saturn and a small pick up truck.

Officers also saw evidence a vehicle had just been driven in the park. Officers saw a large muddy track which damaged or destroyed much of the turf that had been driven over. The tire tracks were approximately 4-6 inches deep in several areas, however, the entire length of the distance was damaged. Estimated distance of damage was approximately one-third mile.

As officers began to question the teens about driving in the park, the suspect, Dunn ran. Officers were able to catch up to him after he slipped and fell in the wet, muddy grass. After investigating further, officers learned Dunn had been the driver of the vehicle that did the damage to the park grass. He was arrested and booked on the above charges.
