012909 Arrest: Battery on an Officer

012909 Arrest: Battery on an Officer
Battery on a Law Enforcement Officer
Suspect: Robert Charles Nichols, 45, Boise
Charge: Battery on a Law Enforcement Officer (F)
Boise Police were called to a one car collision on the 3200 blk of Federal Way Thursday night approx. 9:08 p.m. The driver of the pick up was arrested for DUI. Officers learned there was a passenger in the vehicle at the time of the crash who had walked into a nearby bar. An officer spoke with him, then went out to wait for the tow truck.
The former passenger, Nichols, then walked out of the bar and attempted to get into the drivers side of the pick up. The officer repeatedly told the suspect to get back, that he could not enter the truck. Nichols walked away, but soon returned, and again tried to enter the vehicle.
An officer took Nichols by the arm of his coat to escort him away from the truck. Nichols then grabbed the officers shirt, tearing it, and wrestled the officer to the ground. Nichols attempted to throw a punch at the officer, but missed, got up and ran. The officer caught up with him and took him into custody.
