08-21-08 Overnight Aggravated Assault-DUI arrest

Boise August 21st, 2008 - Officers have arrested a Boise man for Aggravated Assault and other charges after an incident at Tablerock overnight.

What Happened: At approximately 11:40 PM on August 20th a Boise man later identified as Damon Smith was driving his Ford F150 on Table Rock Rd. Another citizen passed Mr Smith, who had pulled over to the side of the road. Mr Smith then followed the vehicle up the road to the top of the Tablerock. When both vehicles arrived at the top Mr Smith, who appeared to be intoxicated, verbally threatened the driver. Mr Smith then retrieved a handgun from his vehicle and pointed the gun at the other driver and two other passengers making verbal threats. The victim's believed the weapon to be a small caliber pistol. One of the victims produced his own handgun and with the help of other witnesses disarmed Mr Smith. The victims then called Boise Police for assistance. It was later determined that the gun the suspect had threatened individuals with was a BB-gun or Airsoft type pistol.

Mr Smith then returned to his vehicle and attempted to leave. When Officers arrived, Mr Smith would not follow verbal commands, and had to be physically restrained and handcuffed for officer safety. 

Arrested: Damon G Smith, 37 years old of Boise

Charges: Aggravated Assault (Felony) DUI with multiple priors (Felony) Resisting and Obstructing (Misdemeanor)
