Aggravated DUI Arrest

Boise, December 6th 2006, Early this morning at approximately 12:50 a.m. Officers observed a white sedan traveling at a high rate of speed with no headlights, veering across lanes westbound on Fairview Avenue. Officers attempted to stop the vehicle using emergency lights as the vehicle turned north onto Cole Road. Turning onto Cole, the vehicle failed to yield to officers and swerved into oncoming traffic.

The suspect vehicle, heading north in the south bound lanes, then collided with another car head-on near Cole and Westwood. The driver of the victim vehicle was taken to the hospital with what appeared to be minor injuries.

    As the first responding officer came to a stop behind the accident, parking his patrol car approx. 50- feet behind the suspect vehicle, the driver of the suspect vehicle shifted into reverse and rammed the Boise Police patrol car, damaging the front drivers side. As a result of this collision the patrol car was kicked back several feet and the suspect vehicle spun in a counter clockwise direction coming to a stop against the curb. A Boise Police Officer was in the vehicle during the collision but did not sustain serious injuries.

The driver of the suspect vehicle identified as Eric Orlando Garza was taken into custody and transported to a local hospital for what appeared to be minor injuries. He has since been released from the hospital and booked into the Ada county jail.

Arrested:Eric Orlando Garza, 25, of Boise

Charges:DUI (Misdemeanor), Leaving the scene of a injury accident(felony), Aggravated Assault (felony)

    Thanks to citizens: Of note, officers were on another traffic stop on Fairview when passing motorists alerted them to this suspected drunk driver by honking their horns as the driver passed. Officers then saw what the citizens saw, the vehicle swerving and traveling without headlights, and officers began their attempt to stop the suspect vehicle. Officers do not have the names of these citizens as they continued on their way, but officers wish to thank those motorists for alerting them to this dangerous driver.
