DUI Driver who strikes building arrested on felony charge; Daily incident report

    Arrested: Antonio V. Carone, 37, Kuna

    Charges: Driving Under the Influence (DUI)(F)

   Boise Police responded to a report of a vehicle that had struck a building on the 600 block of South Vista Avenue early this morning, October 24th, at approximately 1:57 a.m. Officers determined the suspect was backing up in the public parking lot at a bar when he struck a wall, causing minor damage to the building and his vehicle. The suspect, who appeared to be very intoxicated at the time, failed several field sobriety tests and blew a .21/.21. A check through Boise City Records indicated the suspect had prior convictions for DUI in 2007 and 2008, making this charge a felony. After a detailed investigation the suspect was booked at the Ada County Jail on the above listed charges.

TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 80 MOTOR VEHICLES 18-8004. Persons under the influence of alcohol, drugs or any other intoxicating substances.(1)(a)It is unlawful for any person who is under the influence of alcohol, drugs or any other intoxicating substances, or any combination of alcohol, drugs and/or any other intoxicating substances, or who has an alcohol concentration of 0.08, as defined in subsection (4) of this section, or more, as shown by analysis of his blood, urine, or breath, to drive or be in actual physical control of a motor vehicle within this state, whether upon a highway, street or bridge, or upon public or private property open to the public.
