Boise Police detectives levy new lewd conduct charges against incarcerated suspect; Weekend incident report

   Warrant Charged: David C. Loomis, 35, Idaho Department of Corrections

   New Warrant Charges: Lewd Conduct with a Minor (F)

     The suspect was transferred from the Idaho Department of Corrections Friday to face charges on an outstanding Felony warrant.

    The warrant charges stem from an ongoing investigation into an incident that took place in January of 2000 at a Boise home. Evidence indicates the suspect was involved in the abuse of a child under the age of ten who lived in Boise at the time. The suspect, who has been incarcerated for more than ten years on similar charges, now faces the additional count of Lewd Conduct. Boise Police Special Victim's Detectives pursue cases involving the abuse of children to the fullest extent of the law. Further inquiries in this case should be directed to the Ada County Prosecuting Attorney's Office.

TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 15 CHILDREN AND VULNERABLE ADULTS 18-1508. Lewd conduct with minor child under sixteen. Any person who shall commit any lewd or lascivious act or acts upon or with the body or any part or member thereof of a minor child under the age of sixteen (16) years, including but not limited to, genital-genital contact, oral-genital contact, anal-genital contact, oral-anal contact, manual-anal contact, or manual-genital contact, whether between persons of the same or opposite sex, or who shall involve such minor child in any act of bestiality or sado-masochism as defined in section 18-1507, Idaho Code, when any of such acts are done with the intent of arousing, appealing to, or gratifying the lust or passions or sexual desires of such person, such minor child, or third party, shall be guilty of a felony and shall be imprisoned in the state prison for a term of not more than life.

    Arrested: Raymond L. Rutherford, 35, Hailey ID

    Charges: Possession of a Controlled Substance with Intent to Deliver (Meth)(F), Grand Theft (F), Possession of a Stolen Financial Transaction Card (F), Possession of a Controlled Substance (Prescription medication)(m), Possession of Drug Paraphernalia (m)

   Boise Police responded to a citizen report of a person sleeping in a running vehicle at the intersection of Fairview and Curtis Saturday, June 29th, at approximately 4:30 a.m. Concerned for the drivers safety, officers responded to the location. Officers located the vehicle in the intersection with the suspect, later identified as Raymond Rutherford, asleep behind the wheel. As officers contacted the driver they observed a hunting knife in the front seat and received consent to search the suspect's person. A search of the suspect revealed a glass pipe used to ingest drugs. An Ada County Police K-9 alerted on the vehicle indicating the likely presence of drugs. A search of the vehicle revealed a scale, packaging materials, Alprazolam prescription pills, and approximately one gram total package weight of meth. Officers also recovered a wallet with identification, check books and credit cards that officers determined had been stolen. The suspect was booked at the Ada County Jail on the above listed charges.

    Arrested: Kristin Y. Scelzi, 41, Garden City

    Charges: Possession of a Controlled Substance (Meth)(F), Possession of Drug Paraphernalia (m)

   Boise Police on patrol early Sunday morning, June 30th, at approximately 1:20 a.m. observed a vehicle fail to come to a stop at a stop sign located at the intersection of South Orchard and West Camas Street. As officers contacted the driver they determined a passenger, Tristan Padgett, had an outstanding warrant for his arrest on Failure to Appear charges. A Boise Police K-9 named "Jackson" alerted on the vehicle indicating the likely presence of drugs. A search of the vehicle revealed a glass pipe with Meth residue in it. Officers determined the suspects had attempted to conceal the items in the vehicle. The suspects were booked at the Ada County Jail on the above listed charges.

   Arrested: Carrey S. Butler, 19, Boise

   Charges: Burglary (F)

    Boise Police received a report of a burglary in progress at a residence in a neighborhood near Maple Grove and Fairview early this morning, July 1st, at approximately 1:30 a.m. The victim tells police the female suspect, who is not known to her, attempted to gain entry into the home through a window more than once. The suspect also used a pry bar to break the handle on a door at the rear of the residence as she attempted to gain entry. As officers arrived on scene they located the suspect outside at the rear of the home. When officers shined a light on the suspect and yelled "Boise Police", the suspect immediately took off running. The suspect was taken into custody moments later. The suspect appeared to be very disoriented and was wearing very little clothing at the time. After a detailed investigation the suspect was transported to the Ada County Jail and booked on the above listed charges.

   Warrant Arrested: Katie D. Waterston, 19, Cascade ID

   Warrant Charges: Possession of a Controlled Substance (meth)(F)

     The suspect was taken into custody on an outstanding felony warrant for Possession of a Controlled Substance this morning.

    The arrest warrant stems from an ongoing investigation into the possession of less than one gram total package weight of meth at a home on the 6000 block of West Irvine Lane on March 19th of this year. Boise Police visited the home after receiving citizen complaints of possible drug activity. Evidence indicates the controlled substance, discovered during a consent search of the residence, belonged to the suspect. That investigative information was forwarded to the Ada County Prosecuting Attorney's Office and resulted in the felony warrant.

    Arrested: Vickie D. Floyd, 60, Boise

    Charges: Possession of a Controlled Substance (Meth)(F), Possession of Drug Paraphernalia (m)

   Boise Police on patrol observed a vehicle with the headlights off behind a closed business on the 600 block of East Boise Avenue early Saturday morning, June 29th, at approximately 3:00 a.m. The vehicle appeared to be out of place and officers stopped to investigate. As officers contacted the driver, they determined she was currently on probation. Officers conducted a search of the suspect's purse and located four syringes and eight plastic baggies containing a small amount of meth. The suspect was booked at the Ada County Jail on the above listed charges.

   Warrant Arrested: David E. Grindle, 41, Boise

   Warrant Charges: Fraudulent Use of a Financial Transaction Card (F)

     The suspect was taken into custody on an outstanding felony warrant for Receiving Stolen Property Saturday.

    The arrest warrant stems from an ongoing investigation into the use of a credit card without authorization on January 21st of this year. Evidence indicates the suspect used the credit card without the owners permission to obtain goods and services valued at more than $2,000.00. The crime was reported to Boise Police on January 21st of this year. That investigative information was forwarded to the Ada County Prosecuting Attorney's Office and resulted in the felony warrant.

    Arrested: Misty S. Caldwell, 38, Caldwell

    Charges: Possession of a Controlled Substance (Prescription Medications)(F)

   Boise Police observed a vehicle speeding Eastbound on Overland Road Sunday June 30th, at approximately 9:00 a.m. Officers estimate the suspect was travelling at approximately 45 miles per hour in a 35 mile per hour zone. Officers conducted a traffic stop and contacted the driver. The suspect voluntarily consented to a search of her vehicle. Officers discovered a prescription pill for Oxycontin the suspect did not have documentation for. The suspect was booked at the Ada County Jail on the above listed charges.

  Arrested: Dustin D. Hendricks, 25, Boise

   Charges: Burglary (F), Probation Violation Charges (F), Petit Theft (m) 

   Boise Police responded to a report of a theft at a retail store on the 400 block of North Milwaukee Street Sunday, June 30th, at approximately 7:30 p.m. Store employees tell police that they witnessed the suspect conceal a silver bracelet and then leave the store without paying for it. Loss prevention agents detained the suspect until officers arrived. Officers believe the suspect entered the store with the intent to commit the theft resulting in the burglary charge. During the course of the investigation officers determined the suspect had also been involved in a theft of goods from the same store on June 22nd. The suspect was transported to the Ada County Jail and booked on the above listed charges.

   The Boise Police Department has developed a positive, productive working relationship with loss prevention agents from many local retail stores, large and small, local and national chains. The goal of the program is to work with retailers and the Boise business community to reduce retail theft and fraud, crimes that have significant impacts on consumer prices.

  Arrested: Morgan D. Burns, 18, Boise

   Charges: Burglary (F)

   Boise Police responded to a report of a theft at a retail store on the 400 block of North Milwaukee Street Saturday, June 29th, at approximately 3:00 p.m. Store employees tell police that they witnessed the suspect attempt to conceal clothing items and then leave the store without paying for them. Loss prevention agents detained the suspect as officers responded. At one point the suspect and employees were waiting for officers to arrive when the suspect ran out of the building and attempted to flee. Boise Police officers located him in a parking lot and he was taken into custody. The suspect was transported to the Ada County Jail and booked on the above listed charges.
