Boise Police responded to a report of an assault at a residence on the 1200 block of South Lincoln Avenue early Sunday morning, August 5th, at approximately 3:00 a.m. The victim, an adult male, tells officers he had been involved in a verbal confrontation with the suspect over broken beer bottles in the road. Witnesses tell police that at one point during the confrontation the suspect produced a handgun and pointed it at the victim. After a detailed investigation, the suspect, who appeared to be very intoxicated at the time, was transported to the Ada County Jail and booked on the above listed charges.
TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 9 ASSAULT AND BATTERY 18-905. Aggravated assault defined. An aggravated assault is an assault: (a) With a deadly weapon or instrument without intent to kill; or (b) By any means or force likely to produce great bodily harm.[; or] (c) With any vitriol, corrosive acid, or a caustic chemical of any kind. (d) "Deadly weapon or instrument" as used in this chapter is defined to include any firearm, though unloaded or so defective that it can not be fired.
Arrested: Brian R. Mcgraw, 21, Boise
Charges: Possession of a Controlled Substance with Intent to Deliver (Marijuana)(F), Multiple Arrest Warrants for Failure to Appear (m), Probation Violation charges (m)
Officers contacted the suspect as he walked away from the scene of a shooting that took place at a motel on the 2600 block of West Fairview Avenue late Saturday evening, August 4th, at approximately 11:50 p.m. Officers recovered a large bag containing approximately 88 grams total package weight of Marijuana from the suspect's person. A search of the suspect's motel room revealed digital scales and multiple bags of marijuana, pre-packaged in baggies, with a total package weight of 1.5 ounces. Ada County Dispatch confirmed the suspect had two outstanding warrants for his arrest on failure to appear and probation violation charges. The suspect was booked at the Ada County Jail on the above listed charges.
Arrested: Julio S. Garcia, 35, Boise
Charges: 1st Degree Arson (F)
Boise Police and Boise Fire responded to a report of an SUV on fire in front of a residence on the 3100 block of South Apple Street early Saturday morning, August 4th, at approximately 4:26 a.m. The vehicle was destroyed by the fire and a nearby garage sustained cosmetic damage, along with some bushes and trees. Investigators identified the vehicles owner and began to search for answers. After a detailed investigation, officers obtained evidence indicating the suspect had intentionally set the vehicle on fire. The suspect and the owner of the vehicle are well known to each other. After conducting interviews and follow up investigation, the suspect was arrested later that day and booked on the above listed charges.
TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 8 ARSON 18-802. Arson in first degree -- Burning of dwelling or other structures where persons are normally present -- Penalties. Any person who willfully and unlawfully, by fire or explosion, damages: (1) Any dwelling, whether occupied or not; or (2) Any structure, whether occupied or not, in which persons are normally present, including without limitation: jails, prisons or detention centers; hospitals, nursing homes or other health care facilities; department stores, office buildings, business establishments, churches or educational institutions, or other similar structures; or (3) Any other structure which the actor has reasonable grounds to believe is occupied by a human being; or (4) Any real or personal property, whether the property of the actor or another, with the intent to deceive or harm any insurer or any person with a legal or financial interest in the property, or obtain any financial gain for the actor or another; is guilty of arson in the first degree, and upon conviction thereof shall be sentenced to the custody of the department of correction for not more than twenty-five (25) years or fined not more than one hundred thousand dollars ($100,000) or both.
Arrested: Louis D. Scruggs, 34, Boise
Charges: Burglary (F), Possession of Drug Paraphernalia (m)
Boise Police responded to a report of a theft at a retail store on the 1500 block of West State Street Friday, August 3rd, at approximately 11:30 p.m. Store employees tell police they witnessed the suspect conceal items and then leave the store without paying for them. During the investigation the suspect informed officers he had a pipe on his person used for smoking marijuana. Officers believe the suspect entered the store with the intent to commit the theft resulting in the burglary charge. Officers recovered the pipe from a backpack resulting in the possession of drug paraphernalia charge. The suspect was transported to the Ada County Jail and booked on the above listed charges.
Arrested: Paula A. Benally, 39, Chinle AZ.
Charges: Burglary (F)
Boise Police responded to a report of a theft at a retail store on the 8300 block of West Overland Road Saturday, August 4th, at approximately 9:00 p.m. Store employees tell police that they witnessed the suspect, along with a juvenile male, conceal items and then leave the store without paying for them. Officers believe the suspects entered the store with the intent to commit the theft resulting in the burglary charge. The suspect was transported to the Ada County Jail and booked on the above listed charges. The juvenile male, a teenager, was released to the custody of a family member.
