  Warrant Arrested: Sean A. Stuard, 24, Boise

  Warrant Charges:Aggravated Battery (F)

    The suspect was taken into custody on an outstanding felony warrant for Aggravated Battery yesterday.

   The arrest warrant stems from an ongoing investigation into a fight that took place outside a downtown bar on June 27th of 2010. On that date, evidence indicates the suspect was involved in the physical altercation that left the victim with stitches to his face. That investigative information was forwarded to the Ada County Prosecuting Attorney's Office and resulted in the felony warrant.

TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 9 ASSAULT AND BATTERY 18-907. Aggravated battery defined. (1) A person commits aggravated battery who, in committing battery: (a)  Causes great bodily harm, permanent disability or permanent disfigurement; or
(b)  Uses a deadly weapon or instrument;

  Arrested: Mario L. Schuchart, 19, Boise

   Charges: Aggravated Assault (F)

    Boise Police responded to a report of an assault with a gun at a home on the 10000 block of West Garverdale Lane late last night, December 28th, at approximately 11:00 p.m. The victim, who is known to the suspect, tells police his neighbor was having a party and making noise. The victim says that when he asked the suspect to keep the noise down the suspect went into his home, then returned with a shotgun. At one point, the victim tells police the suspect pointed the shotgun directly at him, causing the victim to fear for his life. Officers who responded to the scene located the shotgun in the suspect's residence. Officers have evidence that alcohol was a factor in this incident. The suspect was transported to the Ada County Jail and booked on the above listed charges.

TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 9 ASSAULT AND BATTERY 18-905. Aggravated assault defined. An aggravated assault is an assault:(a)  With a deadly weapon or instrument without intent to kill; or (d) "Deadly weapon or instrument" as used in this chapter is defined to include any firearm, though unloaded or so defective that it can not be fired.
