12-03-10 Camera hidden in bathroom leads to Felony charges; Overnight incident report

   Arrested: Justin D. Tolman, 30, Boise

   Charges:4 counts of Video Voyeurism (F)

   Boise Police responded to a report of video voyeurism at private residence on the Boise Bench yesterday, December 2nd, at approximately 6:00 p.m. The calling party tells police he discovered a video camera concealed in the bathroom. After a detailed investigation Boise Police detectives arrested the suspect for Video Voyeurism. Evidence indicates the suspect had been recording females who visited the home over the past month, as they used the restroom. For further information please follow the arraignment at Ada County Court.

TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 66 SEX CRIMES18-6609.Crime of video voyeurism. "Place where a person has a reasonable expectation of privacy" (i)   A place where a reasonable person would believe that he could undress, be undressed or engage in sexual activity in privacy, without concern that he is being viewed, photographed, filmed or otherwise recorded by an imaging device;(3)  A violation of this section is a felony.

 Arrested: Michael R. Weimar, 20, Boise

  Charges:Possession of a Controlled Substance with Intent to Deliver (Marijuana)(F), Possession of a Controlled Substance (Prescription Medications)(F), Possession of Drug Paraphernalia (m)

  Boise Police Neighborhood Contact Officers, working with information provided by citizen tips through a Crime Stoppers call, served a search warrant
yesterday, December 2nd, at  approximately 9:30 a.m. at a residence on the 6500 block of West York Street. Officers
recovered approximately 16 grams of marijuana, digital scales, packaging materials, prescription narcotic medications and other items of paraphernalia. Officers have evidence that the suspect had been selling marijuana out of the home. The suspect was booked at the Ada County Jail on the above listed charges. A 17 year old juvenile female who was at the home when the search warrant was served was issued a citation for frequenting a place where drugs are used or sold and possession of drug paraphernalia.

    Arrested: Aitor Artiach, 35, Boise

    Charges:Possession of a Controlled Substance (Meth)(F), Possession of a Controlled Substance (Prescription Medications)(F), Driving Under the Influence (DUI)(F), Possession of Drug Paraphernalia (m)

  Boise Police observed a vehicle fail to maintain its lane as it turned onto State street early this morning, December 3rd, at approximately 1:30 a.m. Officers stopped the driver at State and 16th. The suspect, who appeared to be very intoxicated at the time, failed several field sobriety tests and a blood draw was performed for later evidentiary testing. A check through Ada County Records indicated the suspect had prior convictions for DUI making this charge a felony. A search of the suspect's vehicle revealed two baggies with approximately 2 grams total package weight of meth, five prescription medication tablets, a syringe with meth in it and several items of drug paraphernalia in the vehicle. The suspect was booked at the Ada County Jail on the above listed charges.

  Arrested: Terry J. Hughes, 21, Boise

   Charges: Battery on a Law Enforcement Officer (F)

    Boise Police observed an argument taking place between three men on the sidewalk at 6th and Main early this morning, December 3rd, just after midnight. When the men saw the marked police car two of them stopped arguing and began to walk away. The third man, later identified as Terry Hughes, packed a snowball and threw it at the other two men. Hughes then began to run with the other two men chasing after him. Officers stopped the chase. As police attempted to identify Hughes he became combative. At one point, the suspect hit the officer in the chest resulting in the Battery on an Officer charge. The suspect was transported to the Ada County Jail and booked on the above listed charges.

 Arrested: John E. Luna, 48, No Known Address

  Charges:Burglary (F)

   Boise Police responded to a report of a theft at a retail store on the 1600 block of South Vista yesterday, December 2nd, at approximately 5:30 p.m. Store employees tell police that they witnessed the suspect conceal items and then leave the store without paying for them. Officers believe the suspect entered the store with the intent to commit the theft resulting in the burglary charge. The suspect was transported to the Ada County Jail and booked on the above listed charges.

   The Boise Police Department has developed a positive, productive working relationship with loss prevention agents from many local retail stores, large and small, local and national chains. The goal of the BPD Organized Retail Crime Unit is to work with retailers to reduce theft and fraud, crimes that can impact consumer prices.
