11-10-10 Burglars caught in the act and arrested; daily incident report

  Arrested: Lani C. Shands, 38, Boise

   Charges: Burglary (F), Aggravated Assault (F)

  Arrested: David V. Mendoza, 40, Boise

   Charges: Burglary (F), Probation Violation Charges

    Boise Police responded to a Burglary in progress at a residence on the 300 block of South Haines Place late last night (November 9th) at approximately 11:00 p.m. Witnesses tell police David Mendoza began beating on their door and turning the door handles, attempting to gain entry into their home. The victims tell police they do not know the suspects. The victims tell police they told the suspect they had called police and ordered the man to leave their property. After walking away from the front door witnesses say the suspect began trying to get into the victim's vehicle parked in the driveway. At that point one of the residents, an adult male, stepped out of the front door and ordered the suspect to stop trying to get into the car. Witnesses say that's when the second suspect, later identified as Lani Shands, who had been standing next to the street, produced a crowbar and began aggressively moving toward the victim holding the tool over her head in a threatening manner. The victim tells police he retreated into their home and the suspect struck the door more than once with the crowbar. Officers located the two suspects, who appeared to be intoxicated at the time, minutes later walking down Lewis Street. Officers believe the suspects intended to enter the home and take valuables. The suspects were transported to the Ada County Jail and booked on the above listed charges.

TITLE 18 CRIMES AND PUNISHMENTS CHAPTER 9 ASSAULT AND BATTERY 18-905.Aggravated assault defined.An aggravated assault is an assault:
(a)  With a deadly weapon or instrument without intent to kill; or (b)  By any means or force likely to produce great bodily harm.

  Charges:Burglary (F)

   Boise Police responded to a report of a theft at a retail store on the 10000 block of West Fairview yesterday (November 9th) at approximately 4:00 p.m. Store employees tell police that they witnessed the suspect conceal items and then leave the store without paying for them. Officers believe the suspect entered the store with the intent to commit the theft resulting in the burglary charge. The suspect was transported to the Ada County Jail and booked on the above listed charges.

   The Boise Police Department has developed a positive, productive working relationship with loss prevention agents from many local retail stores, large and small, local and national chains. The goal of the BPD Organized Retail Crime Unit is to work with retailers to reduce theft and fraud, crimes that can impact consumer prices.
