06-09-09 Daily Felony Arrest Report
  Boise, June 9, 2009:
 
Arrested: Dione C. Allen, 37, Boise
Charge: Aggravated Battery (F) ISC 18-907(1) b
 
   Boise Police were called to an apartment complex on the 4000 blk of W. State St. approx. 1:20 p.m. Monday, June 8th for a fight with a weapon. When officers arrived they found two women, one who had several cuts on her upper arms. The victims reported that a third woman well known to the victims had arrived at the apartments and an argument began between the three, apparently over a property dispute. The injured victim alleges the suspect, later identified as Allen, pulled a box cutter knife and began to attack her.
   The victims were able to give the officers an ID and suspect vehicle description. Officers located the suspect a short time later, and after questioning, she was placed under arrest on the above charge.
 
18-907.Aggravated battery defined. (1) A person commits aggravated battery who, in committing battery:
(a)  Causes great bodily harm, permanent disability or permanent disfigurement; or
(b)  Uses a deadly weapon or instrument; or
(c)  Uses any vitriol, corrosive acid, or a caustic chemical of any nature; or
(d)  Uses any poison or other noxious or destructive substance or liquid; or
(e)  Upon the person of a pregnant female, causes great bodily harm, permanent disability or permanent disfigurement to an embryo or fetus.
(2)  For purposes of this section the terms "embryo" or "fetus" shall mean any human in utero.
(3)  There shall be no prosecution under subsection (1)(e) of this section:
(a)  Of any person for conduct relating to an abortion for which the consent of the pregnant female, or person authorized by law to act on her behalf, has been obtained or for which such consent is implied by law.
(b)  Of any person for any medical treatment of the pregnant female or her embryo or fetus; or
(c)  Of any female with respect to her embryo or fetus.
(4)  Nothing in this chapter is intended to amend or nullify the provisions of chapter 6, title 18, Idaho Code.

Arrested: Daniel J. McClaskey, 22, Eagle Mountain, Utah
Charge: Burglary (F) ISC 18-1401, Petit Theft (m) ISC 18-2403
 
   Officers were called by employees of a major food retailer on the 100 blk of E. Myrtle in Boise approx 2:43 P.M. Monday, June 8, 2009. Store employees said they witnessed the suspect take and conceal food items, then leave the store without paying. The officers follow up investigation resulted in the Burglary charge after officers found evidence the suspect entered to store with the intent to commit a crime. While investigating, officers also found evidence the suspect had stolen from the same store the previous day, resulting in the petit theft charge. The suspect was arrested on the charges and taken to the Ada County Jail.

Arrested: Courtney M. Weston, 19, Boise
Charge: Burglary (F) ISC 18-1401
 
   Boise Police were called by employees of a major retailer on the 5200 blk of Franklin shortly after 5:00 p.m. Monday, June 8th. The employees reported to officers a woman had come into the business, taken items and left without paying. After investigating, officers believe the suspect, Weston entered the store with the intent to steal the items, thus the felony burglary charge.
