Prosecutors Review of Critical Incident

BANNOCK COUNTY PROSECUTING ATTORNEY MARK HIEDEMAN FINDS NO CRIMINAL CONDUCT IN FATAL POLICE SHOOTING OF APRIL 2, 2007

Bannock County Prosecuting Attorney Mark Hiedeman announced today that there was no criminal conduct by two Boise City Police Officers involved in the fatal shooting of Theodore Hansen at Fred Meyer on April 2, 2007. Leading the investigation was the Garden City Police Department, with the assistance of the Idaho State Police.
The officers involved were attempting to arrest Theodore Hansen on an outstanding felony warrant at Fred Meyer on April 2, 2007. Hansen first resisted arrest and then pulled a knife and tried to stab the officers. Hansen then began to run through the store and then stopped, confronted the officers at which time three shots were fired all hitting the suspect. Hansen had previously made statements that he would not return to prison and made comments to officers at the scene to “go ahead and kill me”. Hansen was wanted for passing forged checks throughout southern Idaho. The shooting was justifiable under Idaho Code §18-4009.
